Quoted hereunder, for your information, is a resolution of this Court dated SEPT 22 1999.
G.R. No. 138226 (Guani Rent-A-Car vs. Hon. Jose P. Soberano, Jr., et al.)
Acting on the motion of petitioner for reconsideration of the resolution of 16 June 1999 which dismissed the petition for certiorari for late filing and payment of the prescribed legal fees as well as for lack of a written explanation for its non-personal service on respondents, the Court RESOLVES to DENY the motion with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought.
The copy of the resolution of 16 June 1999 addressed to Atty. Reymundo Cabalse, counsel for respondents, at B.M. Dimataga St., Lapu-Lapu City, which was returned to this Court unserved with notation "Party Moved," is deemed SERVED on Atty. Cabalse by substituted service pursuant to Section 8, Rule 13 of the 1997 Rules of Civil Procedure, as amended.
