Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 13 1999.

G.R. No. 138341 (Aida Garcia-Jimenez vs, Ishwar Gagnani.)

Acting on the motion of petitioner for reconsideration of the resolution of 26 May 1999 which denied her motion for extension of time to file petition for review on certiorari for failure to serve copy of said motion on the Regional Trial Court, the court RESOLVES to DENY the motion with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought. Besides, the petition for review on certiorari has been denied in the resolution of 21 July 1999 for late filing and lack of affidavit of service of the petition on respondent and proof of service on the Regional Trial Court.

Accordingly, petitioner's manifestation dated 29 July 1999 explaining her failure to serve the Regional Trial Court with copy of the motion for extension of time to file petition and rectifying said error, with prayer that the petition be given due course is NOTED WITHOUT ACTION.
