Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 22 1999.

Acting on the motion of petitioner for reconsideration of the resolution of 14 June 1999 which denied his motion for extension of time to file petition for review on certiorari on the ground that the prescribed legal fees were not paid to this Court in accordance with Section 3, Rule 45 of the 1997 Rules of Civil Procedure, as amended, but to the Clerk of Court of the Regional Trial Court of Iloilo City, the Court RESOLVES to DENY the motion with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought.

The explanation of ATTY. Magdalena L. Lometillo, Clerk of Court, Regional Trial Court of Iloilo City, dated 02 August 1999, on why she received the payment of legal fees from petitioner without authority in compliance with the resolution of 14 June 1999, and the order of Judge Lolita O. Besana of the said Regional Trial Court, dated 20 July 1999, to hold the execution of judgement pending resolution by this Court of petitioner's appeal, are both NOTED.
