G.R. No. 141420 (China Banking Corporation, et al. vs. Court of Appeals, et al.)

In the Court's resolution of 22 March 2000, the petition for review on certiorari of the decision, dated 29 October 1999, of the Court of Appeals in CA-G.R. SP No. 54905 was denied for failure of petitioners to attach thereto a duplicate original or a certified true copy of the assailed decision of the Court of Appeals.

In his motion for reconsideration, dated 14 April 2000, counsel for petitioners alleged that on 13 April 2000, he, together with his liaison officer, had personally verified and inspected the Rollo of the case and "it was definitely ascertained, in the presence of two (2) personnel of the Judgement Division, that attached as Annex 'A' to the Petition for Review on Certiorari filed by the herein petitioners is the certified true copy of the assailed Decision dated October 29, 1999 of the Honorable Court of Appeals in CA-G.R. SP No. 54905, and as Annex 'B' is the certified true copy of the assailed Resolution dated January 6, 2000 of the Honorable Court of Appeals in CA-G.R. SP No. 54905."

An examination of the Rollo would indeed show that attached as Annex "A" thereto was a certified true copy of the decision of the Court of Appeals in CA-G.R. SP No. 46708, promulgated on 29 June 1998 and not, as claimed by counsel for petitioners, in CA-G.R. SP No. 54905.

In view of the foregoing, the Court finds no compelling reason to warrant the reversal of the 22nd March 2000 resolution. Petitioners' motion for reconsideration is DENIED with FINALITY."
