Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated MAR 1 2000.
G.R. No. 136207 (Heirs of the Late Flor Tungpalan, namely Leonila Vda De Tungpalan, Efren G. Tungpalan, Viola G. Tungpalan, et al., vs. Court of Appeals, Spouses Navarro R. Eustaquio and Arabella K. Eustaquio and Register of Deeds of Davao, respondents.)
This resolves petitioners' Motion for Clarification filed on January 4, 2000.
Petitioners aver that on October 11, 1999, this Court issued a Resolution requiring the parties to submit their respective memoranda within thirty (30) days from receipt of notice. On November 15, 1999, another Resolution issued, this time dismissing the petition without awaiting the required memoranda. Petitioner now allege that they are confused as to which resolution prevails.
It appearing that the November 15, 1999 Resolution was issued due to a clerical error, the said Resolution is recalled. Thus, the October 11, 1999 Resolution stands.
WHEREFORE, the Resolution of November 15. 1999 is RECALLED and the parties are hereby required to file their respective memoranda within thirty (30) days form notice.
