PEOPLE vs. DOMINGO LACHICA

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 13 2000.

G.R. No. 94432 (People of the Philippines vs. Domingo Lachica.)

This resolves accused-appellant's Motion for reconsideration of the Decision, dated October 12, 1999, which affirmed with modification the decision of Branch 71 of the Regional Trial Court of Zambales, convicting movant of the crime of murder.

Accused-appellant contends that:

THIS HONORABLE COURT ERRED IN GIVING FULL CREDENCE TO THE TESTIMONY OF REYNALDO OASCASIO AND IN FAILING TO DETECT THAT THERE WAS IMPROPER MOTIVE FOR HIM TO TESTIFY AGAINST HEREIN MOVANT LACHICA.

THIS HONORABLE COURT FAILED TO APPRECITAE CONTRARY EVIDENCE CLEARLY ESTABLIHING THE FACTS THAT DOMINGO LACHICA WAS NOT AT THE SCENE OF THE CRIME AT THE TIME IT WAS COMMITTED."

Evidently, the Motion poses nothing new. The points raised and arguments advanced merely reiterate the issues which had already been extensively discussed and ruled upon in the decision sought to be reconsidered, and after giving the same a second hard look, the Court discerns no sustainable basis for disturbing the same.

IN VIEW OF THE FOREGOING, accused-appellant's Motion for Reconsideration under consideration is DENIED.
