[ G.R. No. 113907. October 2, 2000]

MSMG-UWP, et al. vs. NLRC, et al.

THIRD DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated OCT 2 2000.

G.R. No. 113907 (Malayang Samahan ng mga Manggagawa sa M. Greenfield (MSMG-UWP), Beda Magdalena Villanueva, et al. vs. National Labor Relations Commission, Hon. Cresencio J. Ramos, National Labor Relations Commission, M. Greenfield (b), Inc, et al.)

For consideration are Motion for Partial Reconsideration and Supplemental Motion, dated February 28, 2000 and May 31, 2000, respectively, of the petitioner union, Malayang Samahan ng Manggagawa sa M. Greenfield, and its members, praying for the reconsideration of the decision of this Court in G.R. No. 113907, granting the petition and ordering the reinstatement of the herein petitioners with payment of full back wages.

Among others, the motions seek to modify subject decision to (a) include the names of other employees who were listed in Annex "D" of the petition but were not included in the caption of the original petition; (b) correct the names of some of the individual petitioners whose names were inadvertently misspelled and to (c) include the employees who were similarly situated and dismissed from work but were not mentioned either in Annex "D" or in the caption of the original petition. Petitioners also pray that the individual respondents who were officials of respondent company be held personally liable for damages on account of petitioners' dismissal.

On June 14, 2000, the Court required movants to ventilate the prayers in their motion for Reconsideration and Supplemental Motion, and on August 3, 2000, movants submitted their explanation.

It appears, however, that the names listed in petitioners' Supplemental Motion are different from and do not match the names mentioned in petitioners' Explanation.

IN VIEW OF THE FOREGOING, counsel for petitioners is hereby required to submit to this Court within five (5) days a final, true and correct list of the names of the individual petitioners sought to be corrected.

SO ORDERED.

Very truly yours,

(Sgd.) JULIETA Y. CARREON

Clerk of Court
