Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated DEC 11 2001.

A.M. No. 95-8-08-SC (Re: Establishment of the Philippine Judicial Acadamy.)

For consideration are the following: (1) Letter dated 6 November 2001 of the Sycip Gorres Velayo & Co., Inc. (SGV & Co., Inc.), submitting its proposal for consultancy and related services in support of the Court's evaluation of its investment/ownership of the Ridge Sports and Country Club Corporation; (2) Memorandum dated 16 November 2001 of Justice Ameurfina Melancio-Herrera, PHILJA Chancellor recommending approval of SGV's proposal for consultancy; (3) Memorandum dated 16 November 2001 of Atty. Luzviminda D. Puno, Chairman of the Interim Board, RRCC, recommending a professional fee of P500,000.00 for such consultancy services; (4) Memorandum of Chief Justice Hilario G. Davide, Jr. dated 15 November 2001 to the Prequalification Evaluation and Awards Committee (PEAC) directing it to study the legality of entering into a direct selection negotiation with a consultancy firm; and (5) Memorandum dated 19 November 2001 of the PEAC in compliance with the Chief Justice's memorandum.

The Court hereby APPROVES the recommendation of the PEAC directing it to enter into direct negotiation with Sycip Gorres Velayo & Co., Inc. for the immediate resolution of the issue of ownership of the Ridge Sport and Country Club Corporation before February 2002.Chief Justice Hilario G. Davide, Jr. is further authorized to issue a certification that direct negotiation with SGV is urgently needed considering that time is of the essence in the resolution of the said ownership issue.

RRCC is likewise authorized to enter into direct negotiation with SGV, subject to negotiation of fees based on the recommendations of Justice Ameurfina Melencio-Herrera and the Interim Board of RRCC, and to submit a final proposal after such negotiation to the Chief Justice who is hereby given full authority to approve such final proposal."Puno and Buena, JJ., are abroad on official business.
