PEOPLE vs. ALMIRO y KALAW et al.

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 13 2001.

G.R. No. 138828(People of the Philippines vs. Rogelio Almiro y Kalaw and Efren Perez y Namuco.)

This case is before the Court for automatic review of the judgment of the trial court finding accused Rogelio Almiro y Kalaw and Efren Perez y Namuco guilty beyond reasonable doubt of the crime of murder and sentencing each to suffer the penalty of death.

Before the trial court both accused were represented by Atty. Ferdinand M. Ragaza, Gacias Building, Alfonso Street, Sta. Cruz, Laguna.He even filed a Notice of Appeal for the accused (original record, 245).

In the resolution of 14 December 1999, this Court required the parties to file their respective briefs.A Notice to file Appellants' Brief (rollo, 60) was sent to Atty. Ragaza, being the counsel on record of both accused-appellants.

On 23 February 2000 Atty. Roberto A. Demigillo filed a Motion for Extension of Time to file the Brief for accused-appellant Efren Reyes y Namuco.The motion was granted by the Court in its Resolution of 21 March 2000.

Atty. Demigillo filed the Appellant's Brief for accused-appellant Efren Reyes y Namuco on 4 April 2000.The Office of the Solicitor General thereafter field the Appellee's Brief.

To date, accused-appellant Rogelio Almiro has not filed his Appellant's Brief.Neither has any pleading been filed on his behalf since the case was brought to this Court for automatic review.The record is bereft of any notice of withdrawal as counsel by Atty. Ragaza.

ACCORDINGLY, Atty. Ferdinand M. Ragaza is hereby DIRECTED to show cause, within ten (10) days from notice hereof why he should not be administratively sanctioned or held in contempt of court for failure to file the Appellant's Brief for accused-appellant Rogelio Almiro y Kalaw, and to FILE said Brief within a fresh period of thirty (30) days from notice hereof.
