Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated MAR 28 2001 .
G.R. No. 136326(Paramount Insurance Corporation vs. Tarcisio S. Calilung and RP Technical Service, Inc., et al.)
For resolution is the Motion for Clarification dated March 1, 2001 filed by petitioner Paramount Insurance Corporation.
On June 14, 1999, respondent Tarcisio Calilung filed his comment on the petition.
Respondent RP Technical Services, Inc. failed to file its comment on the petition.
On September 7, 2000, counsel for respondent Calilung filed a "Manifestation with Motion," informing this Court that respondent company had ceased operations and had vacated its last known address at Suite 502, State Financing Center, Greenhills, Mandaluyong City.Respondent Calilung thus prays that this case be deemed submitted for resolution without the required explanation from respondent company's president why he failed to inform this Court of the name and address of its new counsel.
On January 15, 2001, we issued a Resolution denying the instant petition.
We grant petitioner's Motion for Clarification.
The petition should not have been denied.Instead, petitioner should have been ordered to comment on respondent Calilung's motion to consider the case submitted for decision, even without the required explanation from counsel for respondent RP Technical Services, Inc.
WHEREFORE , the instant petition is REINSTATED.
Petitioner is ordered to comment on respondent Calilung's motion to consider the case submitted for decision within five (5) days from notice.
