PEOPLE vs. TRAMBULO

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAY 4 2001.

G.R. Nos. 142694-725 (People of the Philippines vs. Antonio Trambulo y Tonying.)

In compliance with the resolution of the Court on April 3, 2001, Dr. Prudensio P. Banzon, Jr., Director I, Supreme Court Clinic Services, submitted a report, dated April 23, 2001, recommending that the following be done on accused-appellant Antonio Trambulo:

(1) As a diagnostic option, in lieu of C-T Scan, a tissue biopsy of the supraclavicular growth, which may contain evidence of tumor, should initially be considered, to be done as soon as possible in the prison hospital, a "positive" result from which may preclude C-T Scan; histopath examination can be arranged through another government institution, such as the Philippine General Hospital or Rizal Medical Center;

(2) In the event that above procedure, i.e., tissue biopsy, is not feasible due to circumstances, or if it fails to provide conclusive medical findings, . . . subject inmate be allowed to undergo further diagnostic workup, possibly in the form of either:

(a) C-T Scan of the chest and/or

(b) C-T Scan - guided biopsy of the right lung lesion and/or

(c) Bronchoscopy with tissue biopsy, any one of these mentioned procedures to be done in a government institution, such as the Philippine General Hospital, under the supervision of a Pulmonary Specialist assigned by the hospital, to be arranged through the SC Medical Clinic at a specified date and time to be approved by this Court, with the expenses to be sourced from the National Penitentiary Hospital Funds and under Maximum Security with Prison Escort Guards guaranteed by the National Penitentiary; and

(3) All medical developments in this case should be promptly reported for the information and guidance of this Honorable Court.

Considering the foregoing recommendation and finding the same to be in order, the Court RESOLVED to APPROVE the same.

Accordingly, the Director of the Bureau of Corrections is DIRECTED (1) to ensure that accused-appellant is adequately escorted and returned immediately to the New Bilibid Prison after the C-T Scan in the event he has to be examined outside the prison and (2) to inform the Court, copy furnished the Solicitor General, of the return of accused-appellant within five (5) days from the same and the results of accused-appellant's C-T Scan as soon as the same are available.
