Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated NOV 13 2001.

A.M. No. 01-11-02-SB(In the Matter of the Report of the Chief Justice on the dialogue he conducted with Presiding Justice Francis E. Garchitorena and Associate Justice Anacleto D. Badoy of the Sandiganbayan.)

The Chief Justice made an oral report of his dialogue yesterday, 12 November 2001, from 12:00 noon to 4:20 p.m. with Sandiganbayan Presiding Justice Francis E. Garchitorena and Sandiganbayan Third Division Chairman, Associate Justice Anacleto D. Badoy, in the presence of the two other Members of said Division, namely, Justices Teresita Leonardo-de Castro and Ricardo Ilarde, together with the Oversight Committee of the Supreme Court composed of Senior Associate Justice Josue N. Bellosillo, Chairman, and Associate Justices Bernardo P. Pardo, Arturo B. Buena, Consuelo Y. Santiago and Angelina Sandoval-Gutierrez, Members The dialogue was held pursuant to the Memoranda of the Chief Justice issued on 6 and 9 November 2001. Presiding Justice Garchitorena and Justice Badoy were each given sufficient time to air their grievances against each other which were earlier played up by the media.

After the Chief Justice narrated the details of what had transpired during the dialogue, and following some discussions on the implications of the grievances of Presiding Justice Garchitorena and Justice Badoy against each other, the Court RESOLVED to

1. Direct Presiding Justice Francis E. Garchitorena and Justice Anacleto D. Badoy to submit in due form, if they so desire, their respective formal charges against each other within forty-eight hours after notice of this resolution; and

2. Refer their formal charges, if filed, to the Oversight Committee of the Supreme Court, which shall, in due course, take appropriate action thereon.

In the meantime and until further orders of the Court, the Memorandum of the Chief Justice of 6 November 2001 directing Presiding Justice Francis E. Garchitorena and Associate Justice Anacleto D. Badoy "to cease and desist from holding press conferences, issuing press statements, or giving interviews to the media on any matter incident or related to the issues subject of the controversy between [them]" shall remain effective, and any violation thereof shall be severely dealt with.
