Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated NOV 28 2001.

G.R. No. 128845(International School Alliance of Educators (ISAE) vs. Hon. Leonardo A. Quisumbing, Hon. Cresenciano B. Trajano, Dr. Brian McCauley and International School Inc.)

In its Decision dated June 1, 2000, the Court set aside the orders of the Secretary of Labor and Employment insofar as they uphold the practice of private respondent International School, Manila of according foreign-hires higher salaries than local-hires. Entry of judgment was subsequently made.

On January 26, 2001, petitioner International School Alliance of Educators filed a "Manifestation cum Motion to direct private respondent to wholly comply with the Court's judgment." Petitioner complained that while private respondent "adopted a new salary scheme, it limited its application by beginning the scheme on School Year 2000-2001." It prays that the Court direct private respondent "to fully comply with the judgment of this Court by paying back wages due the local-hires beginning School Year 1995-1996 (or from July 1, 1995) to the end of School Year 1999-2000."

It appears to us that this matter is best addressed by the Secretary of Labor and Employment before whom petitioners have filed a motion for the issuance of a writ of execution dated August 20, 2001. In said motion, petitioner similarly alleged that "the School has refused to pay back wages due the rank-and-file and/or members of the Union in spite of the final Order of the Supreme Court," referring to the Decision of June 1, 2000. It prayed that the Secretary "issue a writ to cause the EXECUTION of the Decision of the Supreme Court in GR No. 128845 by directing immediate payment of back wages."

ACCORDINGLY, the "Manifestation cum Motion to direct private respondent to wholly comply with the Court's judgment" filed by petitioner is hereby referred to the Secretary of Labor and Employment for appropriate action.
