Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 10 2001.

G.R. No. 130433(Republic of the Philippines, represented by Vicente Garcia, Register of Deeds of Cavite versus Maximo Planes, represented by Attorney-in-Fact Jose R. Perez.)

In a Resolution dated January 31, 2000, this Court required Jose R. Perez, attorney-in-fact of respondent Maximo Planes, now deceased, to give the names and addresses of the latter's legal representatives for the proper substitution of parties.

On March 31, 2000, Perez filed a motion praying that he be substituted as the legal representative of the late Maximo Planes.

On April 10, 2000, Henry M. Chan opposed the motion of Perez, claiming that he is the lawful assignee and successor-in-interest of the deceased Maximo Planes. Movant thus prayed that the motion of Perez be denied and that he (Henry Chan) be substituted as legal representative of Maximo Planes.

This Court, in a Resolution dated April 26, 2000, required Perez to comment on Chan's opposition. On July 4, 2000, Perez filed the required comment.

Considering the:

1. Motion for substitution filed by Jose R. Perez;

2. Opposition to the motion for substitution filed by Henry M. Chan; and

3. Comment on the opposition filed by Jose R. Perez,

this Court RESOLVES to REQUIRE the Office of the Solicitor, in behalf of the petitioner, to COMMENT on the above incidents within ten (10) days from notice.
