Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated 20 FEB 2002.
G.R. No. 126437 (Josue Arlegui v. Court of Appeals and Spouses Gil and Beatriz Genguyon.)
For resolution is the Motion for Substitution of Parties filed by the heirs (sons and daughters) of the Spouses Gil and Beatriz Genguyon, namely, Gilda G. Genguyon, Ira G. Genguyo, Reylan G. Genguyon, Edwin G. Genguyon, Marilou Genguyon-Rodriguez, and Rosemarie Genguyon-Iwafe, praying that they be substituted as parties to this case in lieu of their parents who passed away during the pendency of this proceeding. Their motion is supported by the Certificates of Death of Gil and Beatriz Genguyon.
In a Resolution dated November 12, 2001, petitioner Arlegui was required to comment on the motion but he failed to comply.
IN VIEW OF THE FOREGOING, and in accordance with Rule 3, Section 17 of the Revised Rules of Court, the motion for substitution of parties is hereby GRANTED.
