RE:HOLD DEPARTURE ORDER ISSUED BY JUDGE LIGAYA

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 21 2002.
A.M. No. 01-11-292-MTCC(Re:Hold Departure Order issued by Judge Merinnisa O. Ligaya, MTCC, Br. 1, Olongapo City.)
Acting on the 1st Indorsement dated 24 May 2000 of Assoc. Commissioner Forter G. Puguon of the Bureau of Immigration relative to the Order dated 28 February 2000 issued by Judge Merinnisa O. Ligaya, MTCC, Br. 1, Olongapo City, for inclusion of the accused in Crim. Case No. 0484-98 in the Bureau's Hold Departure List, considering that the MTCC has no more jurisdiction to issue Hold Departure Orders, the comment thereon of Judge Ligaya stating that what she issued is not a hold departure order but an order for the arrest of the accused, and the Investigation Report dated 25 October 2000 of Judge Ligaya on the circumstances that led to the existence of the two (2) different Orders dated 28 February 2000, the Court Resolves, upon recommendation of Deputy Court Administrator Jose P. Perez in his Report dated 5 November 2001, to: (a) CONSIDER as SATISFACTORY the explanation of Judge Merinnisa O. Ligaya; (b) ADMONISH Mrs. Violeta V. Macam, Clerk IV, and Mrs. Jocelyn A. Atienda, Court Stenographer, both of MTCC, Br. 1, Olongapo City, to be more careful in the discharge of their official duties, with warning that a repetition of the same or similar offense In the future will be dealt with severely; and (C) DIRECT Judge Ligaya to inform the Bureau of Immigration of the circumstances relative to the said Hold Departure Order.
