Quoted hereunder, for your information, is a resolution of this Court dated JAN 30 2002.
G.R. No. 142898 (People of the Philippines vs. Romy Pareja, et al.; Rene Engada alias "Turoy," accused-appellant.)
Atty. Rey D. Qui�on, counsel for accused-appellant Rene "Turoy" Engada, failed to file the appellant's brief for which reason he was required to show cause why he should not be disciplinary dealt with or held in contempt.In response, counsel filed a manifestation in which he stated that he agreed to do so pro bono upon the request of accused-appellant's family on the condition that he be given the complete records of the case, including the stenographic notes, and for this reason he filed his notice of appearance and notice of appeal on accused-appellant's behalf.However, counsel claimed that accused-appellant's family failed to comply with his condition to be given the complete records of the case.Instead, he alleged, he received information that accused-appellant's family was no longer interested in pursuing their appeal.He therefore expressed his desire to withdraw as counsel for accused-appellant.
Accordingly, in its resolution of July 18, 2001, the Court required accused-appellant to comment on Atty. Qui�on's manifestation.However, despite having received the Court's resolution on August 28, 2001, accused-appellant has failed to file his comment.
In order to remove any doubt as to accused-appellant's desire to pursue the appeal, the Court RESOLVED to REQUIRE accused-appellant Rene "Turoy" Engada to show cause why his appeal should not be dismissed within ten (10) days hereof.
The Director of the Bureau of Corrections is hereby ordered to cause this resolution to be served personally on accused-appellant and to explain the contents thereof to him and thereafter to submit his compliance herewith also within ten (10) days from notice.
