RE: Computation of the Longevity Pay

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated MAY 28 2002.
"A.M. No. 02-5-06-SC (Re: Computation of the Longevity Pay (LP) and Step Increments (SI) of Judges of the Lower Courts.)
The Court Resolved, upon recommendation of Chief Attorney Edna E. Di�o in her Memorandum dated 2 May 2002, to APPROVE the following formula for computing the longevity pay (LP) and step increments (SI) of judges of the lower courts, to wit
(1) Longevity pay shall be computed as follows:
(a)� For the first five-year period, by multiplying the basic monthly salary including step increments and salary increases, by five percent (5%) at the end of said first five-year period, with the resulting longevity pay incorporated in the basic monthly salary from the first month of the sixth year until the end of the tenth year;
(b)� For the second five-year period, by multiplying the basic monthly salary including step increments, salary increases and the earned longevity pay, by five percent (5%), with the resulting longevity pay incorporated in the basic monthly salary from the first month of the eleventh year until the end of the fifteenth year;
(c)� The same procedure shall be followed with respect to the subsequent five-year periods, subject to the following guidelines:
(i)� Should there be a difference in the amounts arrived at in applying the recommended computation and the one being practiced, the recommended computation should be given prospective application to obviate such complications as refunds, if any would result.
(ii)� In the event that a recipient Justice or Judge retires, resigns or his services terminated without his fault, or dies after he or she has earned longevity pay, the balance thereof, after deducting the amount already incorporated in his monthly salary and duly received by him, should be granted to him lump sum.
(iii)� Should a Justice or Judge be promoted to the next higher judicial position, his earned longevity pay should remain and/or be added to or incorporated in his new salary.
(2) The proper step increments that have accrued from 1 January 1990 until 1 January 1999 shall be paid starting from the latter date provided that there shall be no back pay for step increments that accrued from 1 January 1990 to 31 December 1998, as the difference between salary actually received and the earned step increments during that period shall be deemed waived and forfeited."
