Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated 18 NOV 2002.

A.M. OCA IPI No. 00-974-RTJ(Jimmy T. Go vs. Hon. Wilfredo D. Reyes, Presiding Judge of the Regional Trial Court of Manila, Branch 36.)

For resolution is complainant's motion for reconsideration of this Court's Resolution dated January 16, 2002 dismissing the instant administrative complaint considering that the matters raised therein have been passed upon by the Court of Appeals in its Resolution dated May 25, 2000.

When the administrative complaint was filed with this Court on June 19, 2000, respondent judge's inhibition on the ground of bias and impartiality was already the subject of a pending petition for certiorari (CA-G.R. SP. No. 58640) with the Court of Appeals which was granted. The established doctrine is that the filing of an administrative complaint is not the proper remedy for the correction of actions of a judge perceived to have gone beyond the norms of propriety, where a sufficient judicial remedy exists, [1] cralaw such as a petition for certiorari, as in this case.

WHEREFORE, complainant's motion for reconsideration is DENIED.
