Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated 12 NOV 2002.
G.R. No. 147589(Ang Bagong Bayani-OFW Labor Party, etc. vs. Commission on Elections, et al.) and
G.R. No. 147613 (Bayan Muna vs. Commission on Elections, et al.)
The Court NOTED the (a) First Indorsement dated 24 September 2002 of Mr. Joseph Bryan Hilary P. Davide, Chief Justice's Staff Head, referring the letter dated 23 September 2002 of Eleuterio D. Coronel and Rafael N. Hernandez, President and Executive Director, respectively, of Bigkis Pinoy Foundation, Inc., relative to these cases; (b) Appearance dated 8 November 2002 of Atty. Froilan M. Bacungan of Froilan M. Bacungan & Associates as additional counsel for COCOFED, in collaboration with its counsel of record; and (c) Manifestation and Motion dated 22 October 2002 filed by counsel for Veterans Federation Party.
Acting on the separate motions to lift temporary restraining order both dated 8 November 2002 filed by afore-named counsel for movant COCOFED and counsel for movant Buhay Hayaan Yumabong [BUHAY], the Court Resolved to require the Commission on Elections, as well as the petitioners, to COMMENT thereon within a non-extendible period of three (3) days from notice hereof.
The Court further Resolved to DENY for lack of merit the (a) motion for reconsideration of AKLAT and (b) motion with leave to admit second motion for reconsideration to show the merits of LDP's unique case, dated 30 October 2002 filed by counsel for private respondent Laban Ng Demokratikong Pilipino [LDP] and its No. 1 nominee, Acmad M. Tomawis.
Aforesaid second motion for reconsideration is consequently DENIED for being a prohibited pleading under Rule 52, Sec. 2 in relation to Rule 56, Sec. 2 of the 1997 Rules of Civil Procedure, as amended.
