Quoted hereunder, for your information is a resolution of this Court dated 18 NOVEMBER 2002

GR No 153753. (National Power Corporation vs. Hon Court of Appeals and Navy Officers Village Association, Inc. [NOVAI], represented by Commo. Eduardo T. Domingo [Ret.] and Ret - Brig. General Brigido T. Paredes).

Considering respondents manifestation with motion for reservation to file comment dated 25 September 2002 stating that on 11 June 2002, they filed a motion for partial consideration of the assailed decision with the Court of Appeals and that to date, said motion for partial reconsideration has not been resolved by the Court of Appeals; with prayer that the proceedings on this petition for certiorari be held in abeyance arid that private be allowed to submit their comment on the petition only after the Court of Appeals has resolve their motions for partial reconsideration in CA-G.R. No. 52852 the Court Resolves to DEFER ACTION on this petition for certiorari until the Court of Appeals resolves: respondents aforementioned motion for partial reconsideration, and to NOTE the motion of respondents Navy Officers Village Association (NOVAI) and RET. Brig. Gen. Brigido T. Paredes for extension of ten (10) days from 15 September 2002 within which to file a comment on the petition for certiorari.
