RE:REQUEST FOR TRANSFER OF ARRAIGNMENT & TRIAL OF CRIMINAL CASES INVOLVING SUSPECTED ABU SAYYAF GROUP MEMBERS

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated 17 SEPT 2002.
A.M. No. 01-7-453-RTC(Re: Request for Transfer of Arraignment and Trial of Criminal Cases Involving Suspected Abu Sayyaf Group (ASG) Members and Other ASG-Related Persons from Zamboanga City to Another Location.)
The letter, dated August 29, 2002 of Ms. Annelee M. Tunac, Officer-in-Charge and Legal Researcher II of the Regional Trial Court (RTC) of Pasig City, Branch 261, in compliance with the Resolution of August 27, 2002, informing the Court that the original records of the forty-one (41) criminal cases for kidnapping and serious illegal detention filed against Kaddafy Janjalani, et al., docketed as Criminal Cases Nos. 123181-H to 123221-H, were received by the Clerk of Court of the RTC of Pasig City on May 15, 2002, and transmitted to Branch 261 on May 27, 2002, is NOTED.
Considering that the original records of the subject criminal cases are already before Branch 261 where the requested Informations may be found, the subpoena dated August 12, 2002 issued by Ms. Tunac addressed to the "authorized representative c/o DCA Christopher O. Lock" to testify and to bring on August 26, 2002 certified true copies of the Informations attached to the Request for Change of venue filed by Atty. Pura Ferrer-Calleja last February 2002, is DEEMED FUNCTUS OFICIO such that compliance therewith by the authorized representative of DCA Lock is unnecessary. Ms. Tunac is hereby ADMONISHED to verify first from the records available to her before issuing any subpoena.
