Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated 30 SEP 2002 :

G.R. Nos. 148037-39. (People of the Philippines vs. P/Insp. Francisco G. Alhambra, et al.)

Submitted for consideration is the undated Motion to Withdraw Cash Bail Bond filed by counsel for accused-appellants, praying that each of the accused's cash bailbond be released to them upon presentment of the original copies of the official receipts issued by the Sandiganbayan.

Supreme Court Adm. Circular No. 2-92, provides:

"3) When an accused is charged with a capital offense or an offense which under the law at the time of its commission and at the time of the application for bail is punishable by reclusion perpetua and is out on bail and after trial is convicted by the trial court of the offense charged, his bond shall be cancelled and the accused shall be placed in confinement pending resolution of his appeal."

Considering that the accused-appellants were found guilty of murder and frustrated murder and sentenced with the penalty of reclusion perpetua by the RTC of Manila, Branch 11 and were incarcerated in the National Bilibid Prisons, to date, the motion is GRANTED and the cash bond is hereby CANCELLED. The Sandiganbayan is authorized to cause the release of the same to the accused-appellants upon presentment of the original receipts and special power of attorney to receive the amount representing the cash bailbond.
