Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 17 2003.

G.R. No. 153627(People vs. Nestor Veluz.)

Accused-appellant Nestor Veluz was found guilty of four (4) counts of rape by the RTC-Br. 96 of Baler, Quezon.He was represented in the trial court by Atty. Gerardo A. Noveras of the PAO, Suclayin, Baler, Quezon.On 27 January 2003, the Judicial Records Office sent a Notice to File Appellant's Brief to the PAO.

On 7 February 2003 the Court received a Notice of Appearance with Motion for Extension of Time To File Appellant's Brief filed by PAO lawyer Atty. Marmarie P. Satin.

On 18 February 2003 Attys. Theodore O. Te and Arturo Q. Tan of the Sanidad Abaya Te Viterbo Enriquez and Tan Law Firm entered their appearance as counsel for accused-appellant with no written conformity from their client.

On 7 March 2003 the Court received a Motion for Extension of Time to File Accused-Appellant's Brief filed by Attys. Te and Tan.

On 18 March 2003 the Court required Attys. Te and Tan to submit within ten (10) days from notice the written conformity of accused-appellant to their appearance as counsel pursuant to Sec. 26, Rule 138, and deferred action on their appearance as counsel for accused-appellant.

On 11 April 2003 Atty. Satin filed a Motion for Additional Extension of Time to File Appellant's Brief.

On 30 April 2003 Attys. Te and Tan filed a Manifestation with Motion for Additional Time to Submit Accused-Appellant's Brief Attached to the motion is a handwritten letter of accused-appellant Veluz dated 29 April 2003 requesting the Sanidad Abaya Te Viterbo Enriquez and Tan Law Firm to handle his case in this appeal.

On 4 April 2003 Attys. Te and Tan filed by registered mail a Motion for Additional Time to File Accused-Appellant's Brief, received by the Court on 13 May 2003.

In view of the appearance of Atty. Marmarie P. Satin of the PAO and the Sanidad Abaya Te Viterbo Enriquez and Tan Law Firm for the same accused, the Court Resolves to REQUIRE Atty. Satin of PAO and the law firm of Sanidad et al. to manifest within seven (7) days from receipt hereof as to who of them should henceforth be recognized as counsel for the accused.

Meanwhile, to avoid delay the motions for extension of time to file appellant's brief filed by Atty. Satin and by Attys. Te and Tan are GRANTED subject to their manifestation called for in the immediately preceding paragraph.
