Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 24 2003.

G.R. No. 154537(Barbero vs. CA, et al.)

RESOLUTION

Acting on the letter dated February 24, 2003 of Atty. Benjamin B. Barbero, which was indorsed to the Third Division by the Office of the Chief Justice, "for whatever action the Division may deem appropriate to take," the Court RESOLVED :

(1) To INFORM the letter-writer that Atty. Lucita Abjelina Soriano did not "arrogate unto herself the power of the ChiefJustice," since she merely wrote a letter informing Atty. Barbero of the action taken by this Court on his letter dated December 23, 2002, which was also referred to this Division by the Office of the Chief Justice. As a member of the bar, petitioner should know that the Chief Justice does not interfere in actions and resolutions of this Court; neither are resolutions of any Division appealable to the Chief Justice or to the Court en banc. Referrals of cases to the Court en banc are governed by Supreme Court Circular 2-89 as amended on November 18, 1993. Other than generalized statements on alleged "hidden agenda" and misplaced verbal harangue on Atty. Soriano, petitioner has not advanced any plausible ground why his case should be taken up by the Court en banc;

(2) To DENY his prayer to refer GR No. 154537 to the Court en banc for utter lack of merit;

(3) To WARN petitioner on his use of intemperate language in addressing letters and other communications to this Court. Abusive language has no place in the legal profession;

(4) To REITERATE that no further pleadings shall be entertained. This controversy must come to an end now; and

(5) To ADVISE petitioner that contempt and other disciplinary actions shall be meted out on him should he fail to heed items 3 and 4 above.
