Quoted hereunder, for your information, is a resolution of this Court dated MAY 6 2003.

G.R. Nos. 98494-98692 (Rogelio Alvizo, Florito Montecillo, Pompeyo Almagro and Catalino Magno, Jr., vs. The Honorable Sandiganbayan and People of the Philippines.)

G.R. Nos.99412-16 & 99436-99636 (Joselito J. Genson vs. The Honorable Sandiganbayan and People of the Philippines.)

G.R. Nos. 99006-20 (Oscar Belcina vs. The Honorable Sandiganbayan and People of the Philippines.)

G.R. Nos. 99059-99259 (Harvey Ruiz, Edgar Osme�a, Guilberto Hermosa and ANICETO ARRIOLA vs. The Honorable Sandiganbayan and the People of the Philippines.)

G.R. Nos. 99887-100084 (Rafael Rabaya and Nestor Rabaya vs. The Honorable Sandiganbayan and People of the Philippines.)

This refers to the petitions for review on certiorari filed by Delia Preagido and Ulrico Bolotaulo seeking the annulment of the decision of the Sandiganbayan dated December 28, 1979 in Criminal Cases Nos. 195, 196, 197, 198, 199 and 200 finding them and their co-accused, guilty of estafa through falsification of official and commercial documents.Said petitions were filed on January 18, 1980 and docketed as G.R. Nos. 52341-46.

During the same period of time, their co-accused had also filed their separate appeals to this Court, to wit: (a) Valentino G. Castillo vs. Sandiganbayan and the People of the Philippines, docketed as G.R. Nos. L-52352-57; [1] cralaw (b) Jose C. Bagasao vs. Sandiganbayan and the People of the Philippines, docketed as G.R. Nos. L-53813-53818; [2] cralaw (c) Isidoro Recamadas vs. Sandiganbayan and the People of the Philippines, docketed as G.R. Nos. L-53694-99; [3] cralaw (d) Rolando R. Mangubat vs. Sandiganbayan and the People of the Philippines, docketed as G.R. Nos. L-53724-29, [4] cralaw wherein the Court affirmed the decision of the Sandiganbayan, convicting said appellants.The corresponding entries of judgment have been issued by the Court.

On July 4, 1991, the Court issued a Resolution consolidating herein petitions of Preagido and Bolotaulo (G.R. Nos. 52341-46) with G.R. Nos. 98494-98692 (Alvizo, et al vs. Sandiganbayan); G.R. Nos. 99006-20 (Genson vs. Sandiganbayan); G.R. Nos. 99059-99259 (Coyoca vs. Sandiganbayan); G.R. Nos. 99309-18 (Belcina vs. Sandiganbayan); G.R. Nos. 99412-16 and 99436-99636 (Ruiz, et al vs. Sandiganbayan); G.R. Nos. 99417-21 & 99637-99837 (Cabusas, et al vs. Sandiganbayan) and G.R. Nos.99887-100084 (Rafael Rabaya Jr. vs. Sandiganbayan), hereafter referred to as "the other consolidated cases" which are all petitions for review on certiorari from the joint decision of the Sandiganbayan dated October 24, 1990 in Criminal Cases Nos. 1143-1341 and 5585-5782, finding the said accused-petitioners guilty on different counts of violation of Republic Act No. 3019, as amended, otherwise known as the Anti-Graft and Corrupt Practices Act.

Examination of the voluminous records of the consolidated cases revealed that the records now with this Court do not include the records of Criminal Cases Nos. 195 to 200 covered by the petitions of Preagido and Bolotaulo (G.R. Nos. 52341-46).Thus, in a Resolution dated April 1, 2003, the Court required the Judicial Records Office to inform the Court of the whereabouts of the original records of Criminal Cases Nos. 195, 196, 197, 198, 199 and 200 entitled "People v. Valentino G. Castillo, et al.", subject-matter of G.R. Nos. 523412-46.

In compliance, Atty. Teresita G. Dimaisip, Deputy Clerk of Court and Chief, Judicial Records Office, submitted her Report dated April 14, 2003 stating that upon verification made by her, the original records of Criminal Cases Nos. 195 to 200 are with the First Division of the Sandiganbayan.

Although not specifically stated in the Report, the records must have been transmitted back to the Sandiganbayan in view of the finality of the decisions of the Court in G.R. Nos. L-52352-57, G.R. Nos. L-53813-18, G.R. Nos. L-53694-99, G.R. Nos. L-53724-29 [5] cralaw and the issuance of the corresponding entries of judgment.

The petitions of Preagido and Bolotaulo remain unresolved.For the proper disposition of said cases, it is necessary that the records of Criminal Cases Nos. 195 to 200 pertaining to G.R. Nos. 52341-46 should be elevated back to this Court.

Moreover, in the interest of orderly adjudication of the consolidated cases and so as not to further delay the disposition of the other consolidated cases, they should be separated from G.R. Nos. 52341-46.

The separation of G.R. Nos. 52341-46 would not affect the other consolidated cases considering that (1) the former involve irregular transactions in the Tagbilaran City Engineering Office committed in 1978 while the latter set involve the anomalous transactions in the Cebu Second Highway Engineering District in 1977; (2) the crime committed in G.R. Nos. 52341-46 was estafa through falsification of official and commercial documents while in the other consolidated cases, the crime committed was violation of R.A. No. 3019, as amended, otherwise known as the Anti-Graft and corrupt Practices Act; and more importantly, (3) petitioners Preagido and Bolotaulo in G.R. Nos. 52341-46 are not accused in the other consolidated cases and the only connection between the two sets of cases is that Preagido was presented as a state witness by the prosecution in the other consolidated cases.

WHEREFORE, the Resolution dated July 4, 1991 consolidating G.R. Nos. 52341-46 with G.R. Nos. 98494-98692, 99006-20, 99059-99259, 99309-18, 99412-16 and 99436-99636, 99417-21 & 99637-99837, and G.R. Nos. 99887-100084 is amended to the effect that G.R. Nos. 52341-46 are SEPARATED from the other consolidated cases.

The Clerk of Court of the First Division, Sandiganbayan is directed to elevate to this Court, within ten (10) days from notice, the records of Criminal Cases Nos. 195, 196, 197, 198, 199 and 200 entitled "People of the Philippines vs. Valentino G. Castillo, et al."
