Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated OCT 15 2003.

A.M. No. P-03-1750 (Clerk of Court Candelaria L. Rivas vs. Tonette M. Salamanca, Court Stenographer III, Regional Trial Court, Branch 217, Quezon City.)

Considering that the administrative complaint dated February 18, 2002 filed by Clerk of Court Candelaria L. Rivas of the Regional Trial Court (RTC), Branch 217, Quezon City against Tonette M. Salamanca, Court Stenographer III of the same court, for habitual absenteeism; the Memorandum dated September 19, 2003 submitted by Deputy Court Administrator Christopher O. Lock that per report of the Branch Clerk of Court of Branch 217, Quezon City, their office is unaware of the present whereabouts of respondent; and the Report dated April 23, 2003 of Court Administrator Presbitero J. Velasco that: (i) the 1st Indorsement dated April 24, 2002 of the Court Administrator addressed to respondent, requiring her to comment on the administrative complaint, was unserved with the notation "MOVED;" and (ii) on December 6, 2001, respondent tendered her irrevocable resignation to Judge Lydia Querubin Layosa (RTC, Branch 217, Quezon City), who in a 2nd Indorsement dated February 11, 2002 stated that she could not recommend acceptance of the resignation since respondent still had untranscribed stenographic notes and that A.M. OCA IPI No. 01-1067-P filed by her against said respondent is still pending with Executive Judge Monina Ze�arosa of Quezon City, the Court Resolves to:

(a)������������� RE-DOCKET this case as a regular administrative matter;

(b)������������� REQUIRE respondent Tonette M. Salamanca to:

(i)��������� COMMENT on the administrative complaint of Branch Clerk of Court Candelaria L. Rivas that she has not reported for work for a total of thirty-six (36) days without filing the required application for leave of absence covering the periods of August 1-3, 7-9, 13-17, 21-24 and 27-31, 2001 and September 3-7, 11-14, 17, 21 and 24- 29, 2001; and

(ii)�������� SHOW CAUSE why she should not be considered as absent without leave and dropped from the rolls.

both within ten (10) days from notice hereof; and

(c)������������� DIRECT respondent to transcribe all her untranscribed stenographic notes.

Let a copy of this Resolution, the herein administrative complaint and its attachments be resent to respondent at "Blk. 12 Lot 18, St. Luke's Lane, La Trinidad Village, Talipapa, Novaliches, Quezon City," the address provided by Deputy Court Administrator Christopher O. Lock in his Memorandum dated September 19, 2003.
