RP vs. CA

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEP 15 2003.

G.R. No. 112115 (Republic of the Philippines vs. Court of Appeals and Ceferino Paredes, Jr.)

This resolves private respondent's motion for reconsideration of the March 9, 2001 Decision which set aside the Decision of the Court of Appeals in CA-G.R. No. CV No. 27990 and reinstated in toto, the Decision of the Regional Trial Court of Prosperidad, Agusan Del Sur, Branch 6, in Civil Case No. 512.

Private respondent claims that he is not guilty of fraud in procuring the issuance of Free Patent No. (X-8) 1253 which was declared null and void. Moreover, he reiterates that the State is estopped from impugning the validity of the said free patent and Original Certificate of Title No. P-8379 in his name.

The instant motion merely reiterates the arguments which had already been passed upon in the assailed Decision. Private respondent, furthermore, raises factual issues which have already been resolved and laid to rest. More specifically, the attendance of fraud is a finding of fact of the trial court which we found to be fully substantiated. The State cannot be estopped from assailing the validity of private respondent's title. The indefeasibility of a title over a public land is not a bar to an investigation by the Director of Lands as to how such title has been acquired, if the purpose of such investigation is to determine whether or not fraud had been committed in securing the title in order that the appropriate action for reversion may be filed by the Government. ^[1] cralaw

IN VIEW OF THE FOREGOING, the instant Motion for Reconsideration is DENIED WITH FINALITY.
