Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated AUG 2 2004.

G.R. No. 163249 (Tagum Mining Development Corporation vs. Court of Appeals, et al.)

G.R. No. 163253 (Tagum Mining and Development Corporation vs. Court of Appeals, et al.)

On May 31, 2004, this Division denied the motion for extension to file petition for review on certiorari in G.R. No. 163249. On the other hand, on June 2, 2004, the First Division ordered the consolidation of G.R. No. 163253 with G.R. No. 163249.

On June 11, 2004, petitioner in G.R. No. 163253 filed a Manifestation and Motion dated June 10, 2004 praying that the case be terminated in view of the amicable settlement of the parties.

In view of the foregoing , the Court Resolves to NOTE and GRANT the Manifestation and Motion of petitioner and CONSIDER G.R. No. 163253 CLOSED AND TERMINATED.
