Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 30 2004 .

G.R. No. 158976 (People of the Philippines vs. Pedro Nogpo, Jr. a.k.a. "Tandodoy".)

The Court is in receipt of the 1st Indorsement dated May 14, 2004 from Reinerio F. Albano, Assistant Director, Anti-Organized Crime Enforcement, Bureau of Corrections, Muntinlupa City, stating that the accused-appellant Pedro Nogpo, Jr., a.k.a "Tandodoy" has no record of confinement in said facility and/or other prisons and penal colonies as of said date. However, the records show that the Regional Trial Court, 5th Judicial Region, Naga City, Branch 25, issued a Final Commitment Order dated July 7, 2003 addressed to the Director of the National Bilibid Prison (NBP), Muntinlupa City, committing the person of said accused-appellant to the NBP.

The RTC, 5th Judicial Region, Naga City, Branch 25, is hereby DIRECTED to INFORM the Court, based on its records, within ten (10) days from notice hereof, when the accused-appellant was actually delivered/committed to the NBP.

The Court GRANTS accused-appellant's motion for extension of forty-five (45) days from 28 May 2004 within which to file appellant's brief.
