[G.R. No. 130710. May 24, 2004]

PEOPLE vs. CABANSAY

SECOND DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAY 24 2004.

G.R. No. 130710 (People vs. Antonio Cabansay, et al.)

In a letter dated March 4, 1998, the Judicial Records Office of this Court requested, through the Branch Clerk of Court of the Regional Trial Court, Branch 18, Cebu City, the following stenographers to submit, within ten days from notice or within five days from filing thereof, the original and three duplicate copies of the stated transcript of stenographers notes:

Stenographer

Hearing Dates

Amparo Suarez

December 16, 1985 and January 28, 1986

Fe Bagano

January 8, 1986

Teodoro Camomot

February 18, 1986 and March 11, 1986

In the Resolution of March 23, 1998, the Court directed the stenographers concerned to submit the required transcript of stenographic notes. Clerk of Court Emelita L. Go informed the Court in a letter dated April 1, 1998 that stenographer Teodoro Camomot already died and that the rest of the stenographers were instructed to submit their transcript of stenographic notes within five days from notice.

On August 5, 1998, Atty. Jose A. Ilustre, then Chief of Office of the Judicial Records Office, reported to the Court that no stenographic notes had been submitted. Subsequently, in the Resolution of March 8, 1999, the Court denied the prayer of stenographer Amparo Suarez in her Manifestation dated September 15, 1998 that she be relieved from her obligation as stenographer in view of her retirement from the service and directed her to transcribe and submit her stenographic notes not later than April 30, 1999.

To date, this case still awaits submission of the abovementioned stenographic notes.

In view of the foregoing, the Court Resolves to REQUIRE Amparo Suarez and Fe Bagano to SHOW CAUSE why they have not complied with the Resolution of March 23, 1998, and to SUBMIT the required transcript of stenographic notes within ten (10) days from notice, under pain of contempt of court.

SO ORDERED.

Very truly yours,

(Sgd.) LUDICHI YASAY-NUNAG
Clerk of Court
