Gentlemen:
Quoted hereunder, for your information, is a resolution of this
Court dated
G.R. No. 133737 (People of the Philippines vs. Jonathan B. Diaz.)
In compliance with the Resolution Of March 31, 2003, requiring appellant Jonathan B. Diaz to inform the Court of the name and address of his new counsel or to manifest if he wishes the Court to appoint counsel de oficio for him should he desire to file a motion for reconsideration of the Decision dated January 13, 2003, appellant sent a letter dated May 16, 2004, portions of which read as follows:
May I respectfully files/submitted a brief narration of fact and most humbly manifest that I desired and certainly not to file a motion for reconsideration nor to request a counsel de oficio. Considering that my counsel has rest in peace, hence, I decided a formal acceptance of the Honorable Supreme Court on its official stand and/or resolution with regard to the case GR. 133737 for affirmed and hopefully be noted.
In the light of the foregoing factual and humanitarian consideration, it is fervently prayed that any assistance and legal remedies extended on my case will be highly appreciated, I understand that your action on my final disposition will be in conformity with the existeng rules and regulations as well as policies and guidelines concerning the matter.
In view of the last paragraph thereof, the Court Resolves to APPOINT the Public Attorney's Office as counsel de oficio for appellant.
