Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAY 19 2004.

A.M. No. 03-7-404-RTC (Letter of Judge Isaac R. de Alban, RTC-Br. 16, Ilagan, Isabela, regarding cases/motions left undecided/unresolved by retired Judge Alfredo Vergara.)

RESOLUTION

In the Resolution of August 11, 2003, Judge Isaac R. de Alban, RTC, Branch 16, Ilagan, Isabela, was directed to start resolving/deciding the motions/cases left undecided by retired Judge Alfredo Vergara from date of receipt of said resolution. Judge de Alban was also advised that should he be unable to decide the cases on time, to request for extension of time within which to decide the cases well in advance of their deadlines to give the Court more time to consider the same.

In a letter dated December 11, 2003, Judge de Alban states that he received a copy of the Resolution of August 11, 2003 on September 18, 2003 and requests for another ninety (90) days within which to dispose of the cases inherited from Judge Vergara. He explains that despite diligent efforts to resolve all these cases with dispatch, the ninety (90)-day period which ended on December 18, 2003, is still not sufficient on account of the enormous number of cases to be resolved and their voluminous records, and that he was also hospitalized for almost one month due to gastric ulcer.

Before acting on the letter dated December 11, 2003 of Judge de Alban, and considering that he did not indicate which of the motions/cases he inherited have been resolved/decided, if any, and which ones remain unresolved/undecided, the Court Resolves to REQUIRE Judge de Alban to SUBMIT, within ten (10) days from notice, a list containing the following information: (a) the motions/cases submitted for resolution/decision which he inherited from Judge Vergara and the dates when they were submitted for resolution/decision; (b) the dates when they were resolved/decided together with copies thereof; and (c) the motions/cases which remain unresolved/undecided.
