DUMO vs. ESPINAS

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEP 20 2004 .

G.R. No. 141962 (Danilo Dumo and Suprema T. Dumo vs. Erlinda Espinas, Jhean Pacio, Phol Pacio, Manny Jubinal, Carlito Espinas and Severa Espinas.)

Considering the Compliance dated July 27, 2004 of Atty. Benedicto L. Nanca, explaining why he incurred delay in securing the conformity of respondents to his withdrawal of appearance, and the attached Manifestation dated July 26, 2004 executed by respondents Jhean Pacio, Phol Pacio and Severa Espinas, stating that the withdrawal of appearance of Atty. Nanca was with their consent and conformity and that they have engaged the services of Atty. Agustin P. Paneda with address at Agoo, La Union as their counsel in this case, and it appearing from said Manifestation that respondents Manny Jubinal and Carlito Espinas did not affix their signatures thereto, the Court Resolves to REQUIRE respondents Manny Jubinal and Carlito Espinas themselves to COMMENT on the aforesaid Compliance of Atty. Nanca and the Manifestation of their co-respondents within ten (10) days from notice.

In the meantime, the Court further Resolves to REQUIRE Atty. Agustin P. Paneda to submit the memoranda of respondents within thirty (30) days from notice.
