Quoted hereunder, for your information, is a resolution of this Court dated OCT 3 2005.

G.R. No. 165734 ( Atty. Ramon B. Ceniza vs. Daniel Wistehuff, Sr., et al .)

In the Resolution of June 22, 2005, the Court resolved to give due course to the instant petition for review on certiorari and required the parties to submit their respective memoranda within thirty (30) days from notice and directed the Court of Appeals to elevate the records of the case within ten (10) days from notice. The respondents, thereafter, filed a Motion for Clarification dated August 4, 2005, pointing out that, while it has a pending case before the Court of Appeals docketed as CA-G.R. SP No. 85301 questioning an order issued in Civil Case No. CEB-26274, the records of this case are still with the Regional Trial Court of Cebu City, Branch 7.

The Motion for Clarification is hereby GRANTED. The Clerk of Court of the Regional Trial Court of Cebu City, Branch 7, is DIRECTED to elevate the records of Civil Case No. CEB-29783 to the Court within ten (10) days from notice.
