COMPLAINT AGAINST ATTY. WILFREDO B. CLAVERIA FOR MISAPPROPRIATION OF JUDICIARY FUNDS

Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of this
Court dated
A.M. No. P-02-1626 (Complaint against Atty. Wilfredo B. Claveria for Misappropriation of Judiciary Funds) and
A.M. No. P-03-1759 (State Auditor II Rodolfo P. Sa�ano vs. Atty. Wilfredo B. Claveria, Clerk of Court VI, RTC, OCC, Pili, Camarines Sur )
The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) DIRECT the Financial Management Office, OCA, to apply so much of the withheld salaries, RATA and other allowances of Atty. Wilfredo B. Claveria to cover his shortage, by remitting the following amounts (representing the shortages) to the corresponding payees, to wit:

(c) DIRECT Atty. Eli C. Posugac, Clerk of Court, RTC, Pili, Camarines Sur, to immediately deposit the checks for Sheriff's Trust Fund (P1,349.95) and Fiduciary Fund (P158,952.50) upon receipt thereof and to furnish the Fiscal Monitoring Division, Court Management Office, OCA, with copies of the deposit slips.
The Court further Resolved to DIRECT the Financial Management Office, OCA, to deduct the fine of
P20,000.00 from Atty. Claveria's earned leave credits
as imposed in the resolution of
