[G.R. No. 170593. October 9, 2006]
PEOPLE'S GENERAL INSURANCE CORP. v. ROBERTO P. EUSTAQUIO
First Division
Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of the First Division of this Court dated OCT. 9, 2006 .
G.R. No. 170593 (People's General Insurance Corp. v. Roberto P. Eustaquio )
In the Resolution dated March 20, 2006, the Court denied the petition for review of the Decision of the Court of Appeals dated November 29, 2005 for being factual, and for the petitioner's failure to sufficiently show that the Court of Appeals committed any reversible error in the challenged decision as to warrant the Court's discretionary appellate jurisdiction.
It appears that on February 2, 2006, a Joint Manifestation was filed by the parties, stating that a compromise agreement was entered into by the parties to put an end to the instant controversy. Said Compromise Agreement dated January 30, 2006 was attached thereto.
Finding the Compromise Agreement not being contrary to law, morals and public policy, the Court hereby resolves to NOTE and APPROVE the same. The parties are, therefore, ENJOINED to COMPLY with the terms thereof. Furthermore, said Compromise Agreement shall be considered as the complete and final satisfaction of the decision of this Court; and, in lieu of any execution herein as a consequence of the finality of the decision in this case. The case is considered CLOSED and TERMINATED.
Very truly yours,
(Sgd.) ENRIQUETA
