By virtue of his authority under Special Provision 1, Chapter XXVIII (Judiciary) of the General Appropriations Act for CY 2003 (R.A. No. 9206) in relation to Section 54 of said Act and paragraph (5) of Section 25 of Article VI of the Constitution; and pursuant to and conformably with Joint Resolution No. 1 of the Constitutional Fiscal Autonomy Group dated 03 April 1992, the Chief Justice hereby grants, on the occasion of the 103^rd Foundation Anniversary of the Supreme Court on 11 June 2004, fringe benefits at the rate of Eight Thousand Pesos (P8,000.00) to each of the Members and officials and personnel of the Court.

The following guidelines shall be observed in the release of the fringe benefits:

1.  COVERAGE

This grant of fringe benefits shall apply to all incumbent Members of the Supreme Court, and the officials and employees of the Supreme Court proper, the Office of the Court Administrator, the Presidential Electoral Tribunal, and the Philippine Judicial Academy whether such employees are permanent, temporary, coterminous or casual, provided that they are such as of 11 June 2004 and have rendered at least six (6) months of actual service as of that date.

Should such actual service rendered be less than six (6) months as of June 11, 2004, the official or employee concerned shall be entitled to P4,000.00.

The foregoing notwithstanding, part-time professors of the Philippine Judicial Academy who have rendered at least six (6) months of actual service as of 11 June 2004 shall be entitled to one-half of the benefit herein granted.

2.  OFFICIALS AND EMPLOYEES NOT ENTITLED TO THE GRANT

The following are not entitled to the fringe benefits herein granted:

a.      Those who are no longer in the service as of 11 June 2004;

b.      Consultants;

c.      Those hired through contract for services; and

d.      Those who have been absent for thirty (30) days or more without filing an official leave application (AWOL)

3.   REFERRAL TO THE CHIEF JUSTICE

Any problem arising from the implementation of this benefit which is not covered by the foregoing guidelines shall be referred to the Chief Justice.

4.   IMPLEMENTING OFFICERS

This Memorandum Order shall be implemented by the Office of the Clerk of Court, Office of the Court Administrator, Office of the Administrative Services and the Fiscal Management and Budget Office of the Supreme Court, and the Office of Administrative Services and the Financial Management Office of the Office of the Court Administrator.

This Memorandum Order shall take effect upon its issuance.
