Syllabus

In this action under the Federal Employers' Liability Act to recover for the death of a brakeman, there was no evidence of negligence on the part of the railroad, and the District Court properly sustained the motion for judgment notwithstanding the verdict. Pp. 340 U. S. 573-578.
