Syllabus

1. The petition for rehearing is granted; the order entered October 17, 1955, denying certiorari is vacated; the petition for certiorari is granted; and the judgment of the Court of Claims is reversed on the authority of United States v. Allen-Bradley Co., 352 U. S. 306 and National Lead Co. v. Commissioner, 352 U. S. 313. Pp. 353 U. S. 98-99.

2. The interest in finality of litigation must yield when the interests of justice would make unfair the strict application of the Rules of this Court. P. 353 U. S. 99.
