DOT follows OMB Circular A–76, Performance of Commercial Activities, and (FAR) 48 CFR 7.3 when cost comparisons between Government and contractor performance are conducted. The contracting officer may insert clause (TAR) 48 CFR 1252.237–73, Key Personnel, in solicitations and contracts when the acquisition is conducted pursuant to OMB Circular A–76 and meets the clause prescription requirements at (TAR) 48 CFR 1237.110(b).
