                     CHAPTER 12--DEPARTMENT OF LABOR
 
Sec. 557a. Mine Safety and Health Administration

    There is established in the Department of Labor a Mine Safety and 
Health Administration to be headed by an Assistant Secretary of Labor 
for Mine Safety and Health appointed by the President, by and with the 
advice and consent of the Senate. The Secretary, acting through the 
Assistant Secretary for Mine Safety and Health, shall have authority to 
appoint, subject to the civil service laws, such officers and employees 
as he may deem necessary for the administration of this Act, and to 
prescribe powers, duties, and responsibilities of all officers and 
employees engaged in the administration of this Act. The Secretary is 
authorized and directed, except as specifically provided otherwise to 
carry out his functions under the Federal Mine Safety and Health Act of 
1977 [30 U.S.C. 801 et seq.] through the Mine Safety and Health 
Administration.

    The Federal Mine Safety and Health Act of 1977, referred to in text, 
is Pub. L. 91-173, Dec. 30, 1969, 83 Stat. 742, as amended by Pub. L. 
95-164, title I, Sec. 101, Nov. 9, 1977, 91 Stat. 1290, which is 
classified principally to chapter 22 (Sec. 801 et seq.) of Title 30. For

                             Effective Date

    Section effective 120 days after Nov. 9, 1977, see section 307 of 
Pub. L. 95-164, set out as an Effective Date of 1977 Amendment note 
under section 801 of Title 30, Mineral Lands and Mining.
