Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of the Court En Banc dated 05 March 2008:
"G.R. No. 169080 (Celestial Nickel Mining Exploration Corporation vs. Macroasia Corporation [formerly Infanta Mineral and Industrial Corporation], et al.); G.R. No. 172936 (Blue Ridge Mineral Corporation vs. Hon. Angelo Reyes, in his capacity as Secretary of the Department of Environment and Natural Resources, et al.); G.R. No. 176226 (Celestial Nickel Mining Exploration Corp. vs. Blue Ridge Mineral Corp., el al.); and G.R. No. 176319 (Macroasia Corporation vs. Blue Ridge Mineral Corporation, et al.).- The Court resolves to:
1. NOTE the consolidated comment/opposition of Macroasia Corporation to the motion for reconsideration of Blue Ridge Mineral Corp. and motion for reconsideration and urgent motion of Celestial Nickel Mining Corporation to refer its motion for reconsideration to the Supreme Court En Banc and to set for oral argument; and
2. EXPUNGE from the records of this case the motion for leave of the collaborating counsel for petitioner in G.R. No. 176319 and for thirty (30) days from 2 February 2008 within which to file a supplement to the motion for reconsideration to further support its arguments that the questioned decision's interpretation of Secs. 77(a) and (b) of RA 7942 are inconsistent with the legislative intent behind the enactment of said law, the same being in the nature of a second motion for reconsideration which is a prohibited pleading under Section 2, Rule 52 in relation to Section 4, Rule 56 of the 1997 Rules of Civil Procedure, as amended.
Acting on the separate motions for reconsideration of Blue Ridge Mineral Corp. and Celestial Nickel Mining Corporation, both of the Decision dated 19 December 2007, the Court further resolves to DENY the motions for reconsideration with FINALITY, the basic issues raised therein having been duly considered and passed upon by the Court in the aforesaid decision and no substantial argument having been adduced to warrant the reconsideration sought.
Carpio, J., no part, having voluntarily inhibited himself; Chico-Nazario, J., designated member pursuant to Adm. Circular No. 84-2007.
