AIKEN O. BRITANICO V. PEOPLE OF THE PHILIPPINES
G.R. No. 195399 (AIKEN O. BRITANICO v. PEOPLE OF THE PHILIPPINES) - Considering the allegations, issues and arguments adduced in the petition for review on certiorari assailing the Decision dated October 12, 2010 and Resolution dated January 21, 2011 of the Court of Appeals, Manila, in CA-G.R. CR No. 29109, the Court resolves to DENY the petition for failure to sufficiently show any reversible error in the assailed judgment and AFFIRMS said Decision finding petitioner Aiken O. Britanico guilty beyond reasonable doubt of violation of Section 10 (a) of Republic Act No. 7610 otherwise known as Special Protection of Children Against Child Abuse, Exploitation and Discrimination with MODIFICATION on the penalty imposed as follows: four (4) years, two (2) months and one (1) clay, as minimum, to six (6) years and one (1) day, as maximum, applying the Indeterminate Sentence Law and considering the presence of the mitigating circumstance of passion and obfuscation in accordance with Article 64 of the Revised Penal Code.
