Quoted hereunder, for your information is a resolution of the Third Division of this Court dated 11 July 2007:
G.R. No. 177667 (Cleodia U. Francisco, et al. vs. Spouses Jorge C. Gonzales and Purificacion W. Gonzales, et al.) - After deliberating on the petition for review on certiorari with prayer for temporary restraining order and writ of preliminary injunction assailing the Decision dated 30 April 2007 of the Court of Appeals in CA-G.R. SP No. 79666, the Court, without necessarily giving due course thereto, resolves to require respondents to COMMENT thereon (not to file a motion to dismiss) within ten (10) days from notice and ISSUE a TEMPORARY RESTRAINING ORDER, as prayed for enjoining respondents Spouses Jorge C. Gonzales, the Regional Trial Court, Branch 256, Muntinlupa City, the Register of Deeds, Makati City or Sheriff Benito Cusi, and/or their agents and assigns, from implementing or enforcing the RTC Orders dated 08 July 2005 cancelling TCT No. 167907 and 13 February 2006 issuing a writ of possession in Civil Case No. 01-201, until further orders from this Court.
The Court further resolves to require petitioners to POST a CASH BOND or a SURETY BOND from a reputable bonding company of indubitable solvency with terms and conditions acceptable to the Court, in the amount of ONE HUNDRED THOUSAND PESOS (P100,000.00), within five (5) days from notice, otherwise, the temporary restraining order herein issued shall automatically be lifted. Unless and until the Court directs otherwise, the bond shall be effective from its approval by the Court until this case is finally decided, resolved or terminated.
