PEOPLE OF THE PHILIPPINES V. AUGUSTO CAPONPON

Quoted hereunder, for your information, is a resolution of this Court dated 22 April 2009:
RESOLUTION
G.R. No. 183454 (People of the Philippines v. Augusto Caponpon)- Considering the allegations, issues and arguments in the appeal, the Court resolves to DENY the same for failure to show reversible error in the assailed Decision.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the August 30, 2007 Decision of the Court of Appeals in CA-G.R. CEB-CR-HC No. 00267 affirming with modification the August 4, 2000 Decision of the Regional Trial Court of Bacolod City, Branch 48, in Crim. Case No. 95-17053, finding appellant Augusto Caponpon guilty beyond reasonable doubt of murder, and sentencing him to suffer the penalty of reclusion perpetua and ordering him to pay the heirs of the victim the amounts of P50,000.00 as civil indemnity, P50,000.00 as moral damages, and P9,500 as actual damages, and AFFIRMS said Decision in toto.
Costs against appellant.
