Quoted hereunder, for your information, is a resolution of the Court En Banc dated March 9, 2010
"G.R. No. 190529 - Philippine Guardians Brotherhood, Inc. (PGBI), represented by its Secretary-General GEORGE "FGBF GEORGE" DULDULAO -versus- Commission on Elections.
R E S O L U T I O N
After considering the arguments and positions raised by the petitioner Philippine Guardians Brotherhood, Inc. in its motion for reconsideration of our Resolution of January 12, 2010 dismissing the above captioned petition, and the arguments and positions raised by the respondent Commission on Election in its Comment, we RESOLVE to:
"G.R. No. 190529 - Philippine Guardians Brotherhood, Inc. (PGBI), represented by its Secretary-General GEORGE "FGBF GEORGE" DULDULAO -versus- Commission on Elections.
After considering the arguments and positions raised by the petitioner Philippine Guardians Brotherhood, Inc. in its motion for reconsideration of our Resolution of January 12, 2010 dismissing the above captioned petition, and the arguments and positions raised by the respondent Commission on Election in its Comment, we RESOLVE to:
- GRANT the motion for reconsideration of our Resolution of January 12, 2010; accordingly, the petition is REINSTATED in the Court's docket; and
- REQUIRE the respondent to file a comment to, not a motion to dismiss, the Petition within ten (10) days from receipt of this Resolution. Considering however that the basic issues involved in the petition has been fully threshed out in the parties' submissions, and considering further the urgency of resolving this petition, the respondent may instead opt to file a Manifestation, within five (5) days from receipt of this Resolution, that it is adopting its Comment to the motion for reconsideration as its comment to petition."
