PEOPLE OF THE PHILIPPINES v. RONALYN MANATAD Y GAVIOLA
G.R. No. 197040 (People of the Philippines v. Ronalyn Manatad y Gaviola).- The records of this case were elevated to this Court on June 14, 2011, pursuant to the Court of Appeals Resolution dated January 26, 2011 which gave due course to the notice of appeal filed by the accused-appellant Ronalyn Manatad y Gaviola.
In compliance with the Court�s Resolution dated September 12, 2011, accused-appellant filed her supplemental brief and the Office of Solicitor General filed a manifestation and waiver that they will no longer file their Supplemental Brief with this Court. The Office of the Solicitor General stated that their position respecting the merits of the instant case has been adequately discussed in the Appellee's Brief dated 15 September 2008.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision warranting the exercise of the Court�s appellate jurisdiction. cralaw
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated December 15, 2010 of the Court of Appeals in CA-G.R. CR-H.C. No. 03140, finding accused-appellant Ronalyn Manatad y Gaviola guilty beyond reasonable doubt of violation of Section 5, Article II of R.A. No. 9165 and to suffer the penalty of Life Imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00). Accordingly, the decision of the Court of Appeals is AFFIRMED.
