RE: ASSISTANCE TO COURT DRIVERS INVOLVED IN VEHICULAR ACCIDENTS WHILE ON DUTY.

Quoted hereunder, for your information, is a resolution of the Court En Banc dated June 12, 2007
"A.M. No. 07-5-19-SC - Re: Assistance to Court Drivers Involved in Vehicular Accidents While on Duty.- The Court Resolved to NOTE the Memorandum dated April 13, 2007 of the Office of the Chief Attorney, in compliance with the instruction for said office to study and recommend action on the Memorandum dated February 1, 2007 of Atty. Eden T. Candelaria, Deputy Clerk of Court and Chief Administrative Officer.
The Court further Resolved, upon the recommendation of the Office of the Chief Attorney, to
"A.M. No. 07-5-19-SC - Re: Assistance to Court Drivers Involved in Vehicular Accidents While on Duty.- The Court Resolved to NOTE the Memorandum dated April 13, 2007 of the Office of the Chief Attorney, in compliance with the instruction for said office to study and recommend action on the Memorandum dated February 1, 2007 of Atty. Eden T. Candelaria, Deputy Clerk of Court and Chief Administrative Officer.
The Court further Resolved, upon the recommendation of the Office of the Chief Attorney, to
(1) DIRECT the OFFICE OF ADMINISTRATIVE SERVICES to
designate one of its lawyers to monitor the Court proceedings in lower courts arising from vehicular accidents involving Court vehicles while its drivers are performing official functions;
(2) DIRECT the NATIONAL COMMITTEE ON LEGAL AID (NCLA) of the INTEGRATED BAR OF THE PHILIPPINES (IBP) to provide legal assistance to Court drivers involved in vehicular accidents, including Rodolfo N. Lupango and Proceso U. Sepulveda, under the following procedure:(a) after such vehicular accident shall have been reported to the Office of Administrative Services, the Chief Administrative Officer shall immediately inform the IBP President of the possibility of a Court driver being charged in court;(3) DIRECT the Chief Administrative Officer to assist all Court drivers involved in similar cases find bondsmen or means by which they can pay litigation and incidental expenses; and
(b) the IBP President shall forthwith inform the Chief Administrative Officer who among the lawyers in the NCLA shall provide legal assistance to the court driver, from the filing of charges until the termination of any case filed;
(c) the lawyer from the IBP-NCLA shall report to the Chief Administrative Officer the status of the case at least once every quarter from the filing of charges against the Court driver and all throughout the proceedings, or upon the immediate termination of the case;
(d) the Chief Administrative Officer shall then report to the Chief Justice the status of the case; and
(e) the Chief Administrative Officer shall immediately request the IBP President to assist Lupango and Sepulveda;
(4) AMEND the Resolution of August 29, 2006 in A.M. No. 06- 8-17-SC (Re: Vehicular Accident on July 25, 2006 Involving SC Shuttle Bus with Plate No. SEG-366 to state as follows:A.M. No. 06-8-17-SC.- Re: Vehicular Accident on July 25, 2006 Involving SC Shuttle Bus with Plate No. SEG-366.- The Court Resolved, upon the recommendation of the Clerk of Court and the Office of the Administrative Services, to ABSOLVE Mr. Rodolfo N. Lupango from [any] administrative liability [involving the Shuttle Bus accident which occurred on July 25, 2006] ARISING FROM THE JULY 25, 2006 ACCIDENT INVOLVING SHUTTLE BUS WITH PLATE NO. SEG-366. (Insertions in capital letters; deletions in brackets.)" Quisumbing, J., on official leave.
