Quoted hereunder, for your information, is a resolution of the First Division of this Court dated 12 January 2009

G.R. No. 173481 (PEOPLE OF THE PHILIPPINES V. RICARDO DE GUZMAN). - On the basis of the allegations, issues and arguments presented in the appeal, the Court resolves to DENY the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its challenged decisions dated March 30, 2006 as to warrant the exercise of this Court's appellate jurisdiction in this case.

IN VIEW WHEREOF, the Court ADOPTS and AFFIRMS the findings of fact and conclusions of law in the Decision dated March 30, 2006 of the Court of Appeals, in CA-G.R. CR HC 01417, finding appellant Ricardo de Guzman guilty beyond reasonable doubt of rape, sentencing him to suffer the penalty of reclusion perpetua, and to pay P50,000.00 as moral damages.
